Today on the way back from work my missus was in some traffic down a side street. Infront of her was a large lorry and infront of that one was another lorry. The lorry immediately infront of the missus was getting impatient so decided to reverse to try and turn to take a juction that he had just passed. The missus saw his reverse lights come on whacked it in reverse sounded the horn and tried to get away. BANG!!!!! The lorry reversed into our car. The driver of the lorry said
'you wasn't in my mirrors so was too close to the wagon'.
Anyways the wife gave him so vergal back because she said he began to seem agressive. They swapped details and she came home. When I came back from work she told me. My first question was 'Are you and the boys okay' (I have 2 small boys, one 2years and another 9months) they are fine.
I have phoned the company involved and they are going to speak to the driver tomorrow. The md at the company asked me what the damage was and I told him so hopefully they will fix it. My main question is though, if they don't repair it and I have to go through my insurance will I have to pay my excess as it's not our fault?

Not her fault at all. Duty of care is ALWAYS on the driver of the reversing vehicle.

Thats what the horn is actually for, to warn other road users that you are there (not to show your agression as some think) so, if your missus used the horn to warn the driver of the truck that she was there, its the truck drivers fault. Its the truck drivers fault as he was reversing anyway, like Coupe said. Just because he could not see her in his mirrors is no excuse, and ignorance is no defence.

Agree with the above. He is completely at fault and it won't raise any issues with your insurance.

Also, anybody who says "you wasn't" is automatically to guilty and should be locked up

Here in the U.S., if reversing on a public road you're always at fault if you hit something.

So by his logic, your lass should have been about 20 or 30 feet back so that he could see her in his mirrors. BAC.

Most of the times, argument on driving issues between women and men tend to get pretty bad, good this one end up OK

if the driver behind was not in the lorry drivers sight they may have a case to say that you were situated to close to the lorry! so you may lose that one! and some lorrys have signs saying "stay back or i cant see you".

Well lads I phoned the company involved and the driver had not reported it. The Md who I spoke too was furious with the driver that he had not reported it. I had the feeling that he's done something like this before. The Md was ace and helped me loads.
I phoned my insurance and they sorted out the pick up of the car tomorrow, someone will access the damage and tell me whats gonna happen with it. The person from my insurance said it will more than likely be written off, but nothings coming out of our pockets as our car was stationary when the accident happened. I ain't that fussed what the outcome is as most importantly my wife and kids wasn't hurt, a car is only a lump of steel anyways.......unless it's a mini.

It is amazing that considering how cheap the technology is, that all such vehicles arent fitted with rear view cameras, or at a minium parking sensors.

The blind spots even behind a small van can be bad, but with a large truck, they are huge.
And most big trucks could reverse into something and not even know about it.

But clearly the driver of the truck is a complete and utter idiot if he didnt report it to his employer. Like did he really think the person he drove into wouldnt report it ???

What a bunch of ARSEHOLES!!! I've been on the phone to 'hastings' (our insurer) for 2 afternoons, only to be told 'your car is a wright off and your wont get a courtesy car as the wright off will not get confirmed till tuesday' Basically a bloke is gonna look at it tuesday. If he thinks it can be repaired we car have a courtesy car, if not we get paid off. I'm putting a claim in for loss of earnings and phone calls as I've made them all and no one has chased up anything.
I'm close to bosting someone's god face! (thats how we talk by me ) )

Afraid thats how they all work kid. Like the boys say though lorry drives fault completley!

If your insurance company wont give you a car in the meantime, then the lorry drivers insurance are obliged to as he is at fault.

They might piss and moan about it, but as its his fault, and its left you out of pocket and without transport, they should provide that for you.

The other thing you can do is to call your legal cover people directly who will also provide that service for you and will then charge it to the other parties insurance once everything goes through.

if you dont get any joy ring the police lodge complaint of dangerous driving (would get bumped down to a careless) a quick statement and voila driver is in the shit company is in the shit....then if you are still not satisfied good old newspapers work onders buddy...

from what you have said it is a cut and dry careless driving if he could not see in his mirrors he should have got out to check...or not move !
