In all honesty...I think its 50/50 now. Tough call. End of the day, the bloke is okay and he can still get home on his bike.

I once took out a motorcycle at some traffic lights. I had pulled a bit too far to the right and he came down the middle of the road. The bike ended up buried under the car radiator.

Sorry to hear about the accident and hope you are ok.

You were not at a junction as some have assumed but pulling out of a petrol station, which amounts to pulling out of a drive way. second you exited at the guidence of the another driver who stopped to let you out. Had she checked her mirrors she would have seen the biker and would hopefully have thought better of continueing with her goodwill gesture. As for over taking at a junction, for the misguided amonst us its not the junction on the left that this rule is guarding you from for the most part its the juction on your right, as pointed out in an above post you would be on the wrong side of the road head on with another vehicle turning left out of said junction. If you pull out and block the carriage way and then are hit broadside you are in the wrong. This happened to my sister inlaw, she had edged out to turn right and was across the wrong side of the road, at the time she was blocking noones path but at the same time noone felt benevilent enough to let her in. Que approaching land rover, now instead of stopping, this shit proceeded to slow to a crawl and just nudge into the door of her car. There was a little damage to the door of the car and none to the bars on the range rover. However seeing as her car was stopped across the lane she was deemed to be in the wrong although the man by his own rantings deliberetly nuged into her car because he was sick and tired of people pulling out and blocking his lane and making him stop. His exact words were, "I could have stopped but why should I you should not have been there I hope this teaches you a lesson". Sorry but this was your fault. Own the day

If your vehicle is stationary, and not newly stationary but has been for at least a short time, and someone runs into it, it is 100% their fault. No way would I have ever let him get away with that when I was working in insurance claims. As a lifelong motorcyclist (over 50 years) I have to say that the rider seems to have been very unobservant, at the very least. If you are overtaking, and thats what he was doing, in poor conditions, then you should be aware that approaching a filling station this might happen. A filling station is pretty visible and the gap in the traffic, observed from the vantage point of the rider, should have been a good clue.He was not looking properly and sounds as if he was travelling too fast for the circumstances.

Bad luck Jason, look at it along the lines of, the bike rider was able to ride home and is still intact, and your car can easily be repaired with a new bumper. No loss of life, no major injuries, and at the end of the day, we pay insurance for the material objects to be repaired in the event of an accident.

Of course, you were stationary at the time of the collision and had been long enough for the rider to stop, had he been paying attention.

what has listening to an ipod got to do with things here? there's no difference to playing music to loud in your car etc. i've been listening to my ipod for nearly a year now. granted i mainly do it as my hairdryer of a bike is so ruddy loud i use it to drown the noise as i cant hear anything anyway. but i dont find it distracts me if anything i pay more attention.

Like was said above this is a can of worms. But I have to agree with the Ipod comment I rode with My Mp3 player for over 4yrs and with bike to bike comms and it never caused a problem in concentration. At least you were both insured. Own the day
