That looks like their mind was made up before the hearing, which they cannot do. If you have a witness to this, it will go in your favour.

I know somebody who was sacked for gross misconduct (he had left the takings from several vending machines in a works van that was subsequently stolen), but had it overturned at a tribunal. It wasn't that they weren't entitled to sack him, the tribunal was in agreement that it was gross misconduct, but it was because they had decided to sack him before they had disciplinary hearing.

Consulat a solicitor, you can usually get consulation for free.
and I wouldnt be surprised , if you could resign and claim constructive dismissal, based upon breach of trust by your employer, making it impossibe to work there.
The question to ask is do you still want to work there ?

Richspec and Stefaz are totally correct. You HAVE to be offered at least 24 hrs notice so you have the opportunity to have a representative with you at time of the meeting. You were given the appropriate notice but not offered the chance of having a witness, so the outcome of the meeting becomes void. Constructive dismissal is possible but not 100% guaranteed! You MUST document everything if you are going to proceed with any grievance. Really look at what you want to do and any long term ramifications from any outcome. Then put a balaclava on drag him to a side street one dark cold night and flog him senseless with a knotted rope whilst attaching electrodes to his nipples! :cool:

Lol, good advise here, thanks gents its given me loads to think about, and retaliate with, the more I think of it, the more I realise Ive been shafted, (I dont mind getting shafted but I at least like being taken out for a meal first,) not taking this laying down by no means! Its not the size of the dog in the fight but the fight inthe dog.
Hogster, have concidered WR amongst other firms, but I think if I leave it will be to do somthing different, been threatening to do somthing else for a few years, this might be the push I needed.
I think this whole matter has highlighted the managements incompitance.
Loving the suggestions of revenge, lol, I will have my day!, every dog does!
Im going to tackle this with my senior engineer, taking into concideration all the point you gents have made above, the only prob he is working away at the moment and so will I be as of tuesday, and neither of us will be back at the branch for 3 weeks, which I can see causing difficulties, is it possible to take minutes, statements and notes via conference call?

Buy a dictaphone tape recorder...they are quite cheap.

Record all convos, telling other parties they are being recorded of course.
When they see a tape recorder, they will be shite scared to say anything, and immediately be on the back foot.

any cctv ? any other (impartial) workers who can give a negative character reference against the shit ?. be carefull how you word your replies !!! have a union rep go with you (ure boss cannot refuse) record the interview, without proof they cannot sack you.

mr X has recently been declined for his threshold PRP and since this time has been verbally abusive towards me, i have advised him that due to his poor quality of work, and attendance he was not eligible to the pay upgrade, in response to this Mr x has been harrassing me on a daily basis outside of work, i have not yet had time to approach you however it was my intention. on (date) at (time) i was approached by Mr x who shouted abuse at me i tried to explain to him again my reasons however Mr X lunged at me and struck me to the face, i in turn grabbed Mr x to prevent any injury to (US BOTH) as a result of my attempts to Restrain Mr X we fell to the ground, i placed my hand on Mr X's throat to keep his face away from mine for fears of being bitten, during the assault he was clearly raged and would not respond to my plea's to stop. I struggled free of Mr X and i advised him as a result i would be invoking disciplinary procedures Monday morning (this is why he has contacted you first sir) i then left the office with my partner. the next thing i was aware of was being contacted by you. I must advise you that it is my intention to seek a criminal case against Mr x and i shall be speaking to police about this matter, Can i also advise you that my partner was present during the attack and should the company wish to suspend me or for that matter dismiss me after my positive loyal service to the firm, i must warn that i shall be seeking advice from my barraster regarding industrial tribunal against the firm. this clearly has been a setup by Mr X as he has realised that by assaulting me he was "In trouble" bearing in mind his father is a serving police officer, and the shame it would bring to him being dismissed for assaulting a supervisor.

Ill be the first to admit I have a foul temper, amd everyone knows I have but5 never would resort to violence, and he is the son of a copper, butter woulnt melt, or so they think. bottom line is, im now beeing disaplinned for gross misconduct which is instant dismissal!
What do I do? its his word v mine, and I feel i havent a leg to stand on, bosses believe the boy as he came off worse, and my misssus didnt see anything? The loosing the job side of things I can handle as had been offered another job last week, the down side is loosing the use of the workshop as have been using it for storage and building stuff for the minus.
Any advise appreciated.

the management should NEVER interview both parties at the same time - it indicates favouritism between both of you and the boss should certainly lose his job over it

Firstly I would like to thank you all for the help and support that has been given throughout this, I has been VERY much appreciated!
Right it has been near a month since this all happened, and with working away for two weeks, being busy at work, and also things outside of work ie the minus, looking for a house, etc etc Ive not had a chance to update this and post the outcome.
Due to how busy I have been at work, I have not spent any time in the office or workshop, which has been great, so the situation has had plenty of time to settle. due to the away work we have been doing, both my self and my senior enginner have not had time to speak to the bosses about the boy, how the firm has dealt with the situation etc etc, untill this week, unknown to me my senior has has a quiet chat with one of my bosses and explained that the boy has been an issue for a while and enlighten him of how the boy that he thought was all perfect and inocent is actially a total cun*. Some of the other engineers have also made there feelings known about him and the situation too, I got asked on mon eve by my boss to spare him 5mins to have a chat about the situation, he sat and listened to all my points, views, and opinions (which is very rare for him!) he has excepted and admitted that the company disputes proceedure failed as I had made comlaints about the boy on several occaisions with no follow up. He asked what I thought was an appropriate way to deal with the boy in light of what he now knows, I was offered an opology, tho not in so many words (have also managed to get thr firm to pay for a college course thats non work related!! result!) But I still have the warning on my record of employment for misconduct, which there is slim chance of shedding for a year, as the Md has made his mind up and never admits hes wrong or made a mistake! (Supprise) On a lighter note I no longer have to work with the little sod, which is fantastic.
So all in all I came out the other side of this realitivly ok, but there is room for improvement, but it could of been worse.
