well, the years starting to pick up now, got a tax rebate this morning for £810.00!!!

got a letter from my advocate today stating:

"The opposing party have confirmed liability will not be an issue, we will now calculate the value and submit your claim"

Hurrah! this went alot quicker then I expected, but I guess it is pretty much an open and shut case...

Good news... Now you can just worry about getting better.

Over here I pay extra for "uninsured/underinsured motorist" If they have no insurance or even insufficient coverage MY insurance coughs up.

Though I'll bet they would put up a fight!!

well bit of an update....so much for open and shut!

just got a letter from my advocate saying that the defendant has paid £2700 into the court, as an offer of compensation.

If i accept they will also be liable for my damages.

If i request more, they will re-asess and I will be liable for any damages.

going to accept as it covers the excess on the insurance, a credit card bill which it will settle nicely, and can put the rest toward getting my yachtmaster practical sussed.

looking back though, im not sure if the whole process was worth it (in my case), as i have been out of pocket £800 (excess), £2000 legal fees for over a year, i know ill now get them back (plus compo), but ive been skint on my arse in the mean time which has sucked.

They played that game with me when I was shunted. I held my nerve and got an extra £500!
