This is a very good point actually Paul. If you can check where the damage is on his car it may clear things up a little further and also help your case. If the damage is on his offside front, which I assume it will be if he's hit your wife in the offside rear, and you can prove that he was driving straight over the roundabout, then that proves that your wife had been on the roundabout long before he had, and was already well into performing her manoeuvre.

If this roundabout is small enough to drive straight over, then I'm guessing its one of these tiny mini-roundabouts, and for him to hit your wife at the rear of the vehicle would suggest that he was travelling way too fast, not only for the conditions at the time, but also for the layout of the road.

I used to work in the liability team for Norwich Union so I've dealt with stuff like this many times before - if you can get photo's and do drawings of the junction, and the skid marks and where the vehicles ended up etc.... they'll be useful for sending to the insurance company, but also if you wanna post them up here, I can try to help as much as possible as I know how frustrating it can be when you know you're not at fault but the other party won't admit it. Often, some good diagrams/photo's and the way you word your report go a long way.

I saw the damage today. Can't believe how far over the rear axel has been pushed...its got to be a good 2-3" accross!

Its gone for an estimate now, cant see it coming back.
I need to find its market value for the insurance. looked on Autotrader and could only find 1 long wheelbase 5 dr but its an auto and LHD. Surprisingly its up for £2600 and the same year as ours.

First pic shows view obscured to the right, second pic shows you cant see a car til its on the roundabout




Third pic is taken from 50ft away where the car that hit her would have been as she was making her manouvre. He would clearly have seen her and should have slowed as she was well into her manouvre.



He would have been travelling above 30mph in the rain, dark and approaching the roundabout.

Fourth pic shows the skid mark on the roundabout showing that he had actually aimed for her.

I dont have a pic of our car atm but the impact is square in the middle of the back wheel proving she was well into her manouvre at the time of impact and the BAC was in the wrong position on the road. If he wasnt ON the roundabout but going AROUND it as he should have, even if he was speeding wouldnt have collided with her.

Thoughts?

Definately looks like he was going too fast.

Paul, as you say, from those pictures it looks clear that the BAC is at fault.

Those skid marks do indeed indicate that he wasn't travelling around the roundabout. Also, the view is much clearer from the direction that the other guy was travelling from, so even at speed he should have been able to see your wife entering the roundabout and should have slowed down accordingly.

I'm at work at the moment, but when I get home tonight, I'll go through them in more detail and see if I can give you some pointers of how to work your descriptions best to the insurance company.
