Looks like the insurers are pointing the finger at me until they speak to the witnesses. I thought if I have to pay the excess, might as well get my car done through the insurance. So it goes in next weekend for repairs....if they don't write the old pup off!

Like you said you went into the side of him. I cant see this going in your favour, your insurance will want to settle this quick to avoid costly personal injury claims. So dont be surprised if they dont give a damn about your side of the story, they will want a car hit biker claim to go away as fast as possible.

From a legal sense I think I did everything possible to avoid an accident and would do exactly the same again, but with the insurance claim and injuries...Josh could be right. Bit of a fooker really. I'll do an update once the insurers speak to the witnesses. May swing it......fingers crossed *wink*

When filtering past slow moving traffic or stationary traffic motor cyclists will find themselves on the wrong side of the white line most of the time so there is nothing especially wrong there. However being a biker of some years when I have to filter in such an instance I pull right across the other lane. doing this unmasks me from the que of cars and gives me a clearer view of any gaps and any vehicles emerging from said gaps. Its not a manover commanly used, but like life the more you do something the more you learn.

If the rider had taken a wider path you might have seen him and if not I guarantee he would have seen you taken avoiding action. Would you have hit him if he was 3ft further over?

Probably not.

Wait in the que of traffic like us car drivers springs to mind Joshua!
The gap in the slow moving traffic which he could move back into was the one I created holding the cars up to pull out......he had far better visibility.

Good start to the new year....its going to County Court. My insurance isn't going to give in due to witness accounts.
On his claim, he has said I just pulled out. Nothing about over taking traffic on the wrong side of the road.

the biker listening to the ipod is not the problem its the biker not paying attention to the road that is a huge problem in this case!!!
i am a biker and i overtake as discribed above BUT i am always aware of what is coming up especialy junctions and always expect to have to stop for some one pulling out. As technicaly its is thair right of way as im on the wrong side of the road.
i no people on bikes that dont watch what they are doing thank fully few and far between.
but!! i also have see a hell of alot of stupid car drivers not paying any attention and not looking out for bikes.

in this case id say as you were pulling on the the other side of the road and he was on the wrong side of the road it is his fault!!!

He should have paid attention to the junction and looked for some one pulling out as people in traffic are nice and let people out. there for he should be ready to stop at any moment!!.


the whole ipod bits is not different to turning your sterio up and i think is nothing to do with it.

When you have your iPod on, can you hear other cars horns? Police Sirens? When you have music on in a car at least it isn't directed direct inside your ears meaning you here nothing else around you. I know when I have the stereo up loud I can still hear mine and other cars horns. Listening to loud music, especially when there is no other sounds to concentrate on, means your concentration can and probably will lapse at some point. Meaning the biker may have been too busy singing along/etc to his music to be fully aware of a car pulling out.

I'm also a bike rider and I would be very aware when filtering through traffic, especially at junctions and entrances/exits. It's just common sense.

Totally agree, its great to actually find an insurer that will back you. I'm with the AA, the insurer is NIG....can't fault them with service, courtesy cars etc.
