the insurance company are point blank refusing to pay more than £307 for the pug, this is regardless of the letters ive written or the cars ive found in the papers and on the net to show them

i can either cash the cheque or take her to small claims court, ive got the forms but it will cost £80 to take her to court and if i loose thats even more down the pan

basically i dont know if i should take it on the chin or take the chance and take it to court, i am sure the law says i should not be out of pocket for her mistakes but where does it say this? realistically what chance have i got of getting the real value of the car?

I'd take the money and run and sell the 405 to cover the rest of the costs. Is it really worth the hassle for a few hundred notes?

What about the insurance ombudsman, can you not get them involved in your case with the insurance company?

it will cost you only stamps and a few well typed letters

write to them stating that.....
if you dont get your money that is rightley owed to you,
you will issue a county court summonds with effect from this date...........& let the courts decide what the cars worth!

ive got the forms mate

the charge depends on how much you claim, ive found out that book price was 1280 on the car but direct line told me it was 700 odd, direct line also knock off £100 here and there for varios dings cracked lenses ect but this practice is not recognised by the FSA

lol at nicky, yeah i'd go with pete too just cos i hate insurance companies! on my very last day of driving i may accidentally crash into a pile of nice cars in a 4x4 just to get them back...

When I was a lad a long time ago my solicitor was shit and I needed money (I had loads of broken bones and a f***d bike) So told my solicitor to inform the other party that I needed to hire a car for transport and I would have to charge them the full hire charges,the money came quick.
With a third party claim you are entitled to compensation for ANY loss.

I rang tesco/direct line today at 4 just to vent some frustrations

spoke to the lady and explained that i was not impressed by the poor service not impressed with being lied to ect ect ect

told her that i had emailed watchdog as i felt that to argue over 3-400 pounds while letting me swan round in a hire car for 8 weeks costing £30 odd pound a day was a disgusting waste of money

said i was out of pocket for over a grand for someone elses mistakes and this was unaceptable

also said they were leaving me with no alternative but legal action

and basically what are they prepared to do about the mess they have created

she said she would speak with the engineers dispute dept, in all the corrispondence i have had with these muppets not once have they put me onto this dept? i waited for ages and she came back and said she would have to ring me back because they were all busy, she came back shortly after 5 saying they had gone home, so i said i would now chase up watchdog and also put a written complaint into the FSA about the way i had been lied to the unethical way in how they deal with claims and the way they try and bully you into accepting a poor amount by just sending you a cheque with no corrispondance, she point blank refused to give me the FSA's details and when i asked why she just said she would not if i was going to make a complaint about them??????? WTF

letter beig drafted up to the FSA this weekend just need to find there details ect
will also try and spek to watchdog on monday

insurance companies are stupid! my mate got knocked off his bike a while ago, i think the bike needed a new set of forks, and a coupl of panels replaced, my mater found somewhere that would do it for a very reasonable price, but the insurance company refused to pay out for it, they did however pay for him to have a hire bike at quite a high cost for at least a couple of months!!!
