South Yorkshire

A friend has been dismissed by his employer and he's asked me to be his witness at a disciplinary hearing (according to his GF I am level headed and have a calming influence on him! *surprised* )

I don't really know what to expect, or what is expected of me. Has anyone been involved in anything like this that could give me an idea?

from what i understand your there to be a witness to what goes on. ie keep quite, make your own notes of what was said and by who.

Cheers for the input. I think the underlying problem is a clash of personalities between him and his boss.

I am a dept. manager, but in the 5 years I've been in the post I've not had to deal with anything like this. I'm lucky as we have low staff turnover and very few problems.

i'm sure you not suposed to say anything. but you should tell your friend to be calm in his approach and ask a lot of questions.

it all depend on why he is being disaplined. if its being late he should highlight other people being later but try not to name names.

if its performance then ask what the targets are and have reasons for not meeting them, a good one is not knowing you had targets

if its personality then the boss will call it something else as this is not good enough grounds. so pick holes.

at the end of the day as long as its not gross misconduct for wich you can be sacked straight away, then its only a verbal warning. then you need two more disaplinaries and get written warnings before being sacked.

also get him to ask for a copy of the minutes of the meeting and say its because he needs to take them to the citizens advise buro (sorry i cant spell for s$£t)

this will make the boss think twice before a written warning as the C.A.B. give free legal advise, implying your take the company to the cleaners if not done correctly.

neil this is my arena. you are there as a witness, but you can put the employer on a backfoot quite easily. make sure you turn up in a full suit. and you "ARE" his leagal rep. make sure you write down notes at all times, and if possible take a dictaphone with you. which you will switch on in front of the guy and ask if this interview may be recorded (he will be frightened to say no) my wife works for a hotel chain and they tried to shaft her, i went as witness (under same guise and give em what for !!!) before you even start i would demand a copy of the employee handbook (statute law every employer must have one issued to all staff...how else do they know what theyre rights are? and when they are doing wrong ?) this must have been signed by your pal, or they dont have a power to discipline !!!!! if they cannot produce this, and your pal maybe getting the sack and not a slap on the wrists, terminate the hearing until they can provied the afore mentioned item (9 times out of 10 they will drop the case or risk industrial tribunal........expensive for firm and they risk public exposure to mal practices) if you search the web on the government websites for employer law you will be quids in. if it is a slap on the wrists and your pal has clearly done summit very stupid then just role with it bud

ps you mention a clash of personalities. play the employer bullying card and you will be sweet.

all firms say you 8nt meant to say anything, but they never stop you, (coz they cant !!!! you are there to make sure that your pals legal rights are adhered to under artical 6 of the human rights act "right to a fair trial")

must also add. you want to see his disciplinary record, ie when he has been told in the past that he is doing wrong....written warnings, verbal warnings, which he will have to have signed as a true record if there is no record trail they cannot sack without a written warning first.........they will try and go down the redundacy reute if they do they cannot employ anyone else in the same role (even if they change the title)

they are obliged to let you legally

when the numpties are finished,

say this ........ you have had your say now its my turn, so sit down shut up! pin your ears back and listen to me *wink*

then give it them!!!!!! *wink*

The only thing I can add is to gather as much information about the reason for dismissal, and any other contributory factors, you need to make sure your mate tells you the FULL story of what has happened.
