I'd take proper legal advice on this one TBH.

I am no lawyer but, I think if a house is jointly owned one of the owners cannot borrow against the house without the full agreement of the other partner.

If the bank has allowed this they are at fault and it may be well worth seeking legal advice on this point. It may not get the Golf course back but it may reduce the debt on your Mother Regards Dave I have just checked with a friend of mine who is a mortgage advisor and your spot on. Seek legal advice against the bank if this is the case. If there is a signiture in your mother name then that is very different as it's all about prooving how it got there. Again legal advice is what you need not just the best guesses of folk. Best of luck ...... Every day is a school day ...........

Feeb .. not sure how I can help mate. The best thing to do is to get somebody who specialises in this sort of thing to represent you mother. Normally if they think there is a case they will be happy to tale payment at the end of proceedings rather than up front.
