This is a new one to me. Just made a listing on ebay for a Zeemax kit I bought years ago, some of you might have seen the post I made in the for sale section about a month ago, anyway. The auction had been up not even a day when I get a message from ebay saying the auction had been canceled at the request of Zeemax citing violation of their intellectual property!

I've emailed Zeemax to find out hat the problem is awaiting a reply. Has anybody got any idea how I might be violating their IP? What a pain in the arse!

Best thing to do is contact ebay and ask if they can clarify what they mean by "intellectual property".

Sounds to me like, Zeemax just don't want you to sell the product as it takes business away from them, even though its only a one off!

Exactly what I was thinking Matty. A search through ebay reveals that there are no other Zeemax kits for sale...

Fairly underhanded on Zeemax's behalf if thats the policy they're pursuing!

Don't understand that, surely the only violation of intellectual property that could occur is if someone was trying to pass off a copy as one of theirs? If it's a genuine Zeemax kit then I can't see the problem. I would ask ebay for clarification.

Neil

I suppose the onus would be on me to prove its genuine. My receipt is lone gone :( I've been onto the place who ordered it for me and they're trying to dig out the original invoice, fingers crossed.

Intellectual property as I understand it relates to pictures or text that they may have pulished for e.g. on their website. Did you copy and paste any text or pictures from the Zeemax website? If so this might be what they object to?

No not at all Tom. Only a few paragraphs of text describing the kit saying it was genuine and four pictures I took of the kit myself. Pretty much what I put in the for sale section on here. The only thing remotely close was I put something like... in fact heres the exact listing;

As new genuine original Zeemax CS body kit. Fits all round nose classic minis. Best quality kit available by an established and reputable company. This means minimal alignment and trimming required to fit (as oppose to all the copies floating about), which will save you a lot of time and money in the long run!

Kit consists of front & rear bumpers, side skirts & arches. Its been stored in bubble wrap so zero chips/scratches. Selling due to change of requirements. Full hi-res pictures from any angle available at request.

Examples of the kit fitted can be found at http://www.zeemax.com/mini.htm

As its a fairly bulky item collection would be ideal but delivery by courier shouldn't be a problem. I would expect postage to be no more than £40 to UK mainland (probably closer to £30).

Maybe they are being shitty as you linked to their site? If so then they are being BAC's IMO.

Don't panic, they're chancing it. Only if you are marketing body kits built to their design are they able to do anything to you (and even then the design has to be registered at the UK patent office). Your simply selling off one of their kits second hand. Autofashion as you know knocks up and sells an exact copy of every kit Zeemax makes so Zeemax are obviously pricky and are keen to defend their design. I suspect that because your kit is new and un-fitted they are just jumping to conclusions that you are profiting from their design.

Yea what a shitter though. They've got ebay to cancel my auction so thats £15 quid down the drain had quite a bit of interest as well (in the short time it was on).

And I can't really see why, they've already had my £700 wheres the harm in me selling it on at a loss... :(

edit: lol just searched BAC, would certainly seem fitting!

You should get your money back. I did when my auction got ended when I mentioned about buying off ebay!!

It might be worth relisting without a link to there website and see how it goes? *oh well*

this has happened a few times recently. Most noteably with auto cad in the US. I personally cant see how they can do it unless they can prove that it is indeed a fake (copy).

Quick follow up. Got in touch with Zeemax and they were concerned I was trying to flog a copy under their name. Didn't have an invoice but they took time to trace the purchase back. So all sorted they even offered to verify authenticity if needed. Thumbs up to Zeemax.

Why do the gods not want me to sell this kit!!

Got round to re-listing the kit the other day. Listed it at about tea time... canceled by bed time! Same deal IP violation, only this time the complaint was from Jetforce Management Limited who it appears are the parent co. for http://www.autofashion.co.uk/ (beware it looks like they employed someone from the myspace school of web design)

Slightly ironic considering autofashion have been in trouble for violating Zeemax's IP.

Snotty emails away.

Give autofashion a rocket up their arse and get your auction costs refunded, you have proof from Zeemax if required that this is a genuine kit, so tell them to f*ck off!
