well after rebuilding the hogbox i have found the problem to the broken laygear.
the shaft was bent, not buy much proberly 1/2thou.
went to put it in the new donar box and she was tight going into the small end .
checked for a lip on the lock slot and gave it a quick file but still tight ( should be a hand press fit).
reput it into the old box and she slid in fine.
so got another oem shaft and she feed in a treat in both boxes so the shaft has bent, i will put it on the lathe and dti it but i recon thats the problem.
as 3rd gear is near the middle and deviation over true will cause the teeth not to engage true thus causing pressure to be on one side of the tooth and not right across it.
mat woods had same problem with broken 3rd and his was even more severe with a twisted case vas well ( not suprised)
so every 2 years i will be checking the layshaft and bearings.
so beware to you all runnning mega nannas just keep an eye out for a tightish shaft ( as the art mistress said to the gardner).
always looking for them bigger bunches of bannanas
