Well, I thought if you advertised a product at a price, you had to sell it at that price. So there's me, brought a clutch plate at the advertised price, they took the money and then i ring them to find out where it is? only for them to turn around and say "sorry it was advertised at the wrong price, its £30 more"

Common missunderstanding that. There is no obligation to sell products at the marked price. They can just not sell it to you if you don't like the price, marked or not. http://www.twin-turbo.co.uk

I wonder how that works if you order on-line. Because onece you have sent your money they have accepted the price. If the on-line store was wrong, tough shit on them I think.

That is a good point. If you have entered a contract with them, i.e received confirmation of the order and paid then they are obligated to meet that contract. http://www.twin-turbo.co.uk

Agreed. Once money has exchanged hands ie. the contract has been made by law they have to honour that contracrt.

Hmmm.. i had a similar issue with minisport a while ago, but they did not take the money. I spoke to trading standards and the said that as they had not taken the money, they had not accepted the contract. Thus i could do nothing, this case on the other hand... if its a decent saving and you want the part it might we worth fighting for... but prob not worth the effort tbo.. |

An advertised price is only an invitation to treat, the seller has no obligation to sell it at that price, this can also work in the sellers favor such as getting a 10% discount on a large order. Also the seller is perfectly obliged to choose who they sell to. On 11th Jun, 2009 ministef1 said:
they took the money and then i ring them to find out where it is? However around the point money changes hands the contract is formed, technically the buyer makes an offer based on the invitation to treat (advertised price) and the seller agrees it and the point of the seller agreeing the contract is formed. There is an obscure clause that if the buyer knows an item is being sold for considerably less than it's true value for example item advertised at £60 when the real value is £600 then the contract is not legally binding. Not really sure what you can do about other than try trading standards mind, I reckon you'll only get your money back I'd be very surprised if you get the clutch for it's advertised price.
