We bought a car from a company called "the car shop" in Northampton. After a week of owning the car it developed a water leak. I contacted the car shop and they advised taking it to our local dealership, so I did.

Both the dealership and the car shop said it wasn't under warranty despite being 2 years old, and coming with a 3 month warranty from the car shop.

It took over a week of phone calls to get the car shop to agree to pay for the repairs, and the car has now been at the dealership for 2 weeks. Ive just been informed that it may be there until the end of the week (so possibly over xmas too) and they don;t have a courtesy car available.

Ive now just phoned the car shop and they have told me that they will also not supply us with a courtesy car as it is not being repaired at there workshop. (even though they told us to take it to our local dealers and never mentioned about taking it there).

When we bought the car it came with a 114 point check, one of which was a check for coolant leaks, and had been signed off ok.

Quite frankly we don't want the car anymore as we are concerned about there after service and don't want to be in this position again.

The car shop say we can't return the car, but after reading the sales of goods act it looks like we have rights? What are your thoughts lads? Have you had a similar problem before?

If you're thinking of buying a car from "the car shop"...stay well clear as there after service is the worst I have ever experienced!

Rant over....

Cheers
Matt

Contact your local trading standards, they will soon get things moving for you, and advise your rights as regards sending the car back to the dealer.

I agree with Tom. But I suggest writing a letter to 'thecarshop' first stating you now have Trading Standards involved who have informed you of your right to a replacement or refund and unless a suitable outcome is reached you will be handing the case over to them to carry out.

If they know your rights they will back down. I had an issue with Carphone early this year when they wouldn't replace my phone and I dropped the TS name and they changed their tune and got it sorted.

I think do the letter and if they want to be nobbers then get TS in on it. Try to keep all correspondence to letters, emails or texts if you can so you have physical proof of what has been said, etc. Any documents keep safe aswell as you may very well need them.

Trading standard it is then!

My main concern is that it has overheated because of the water leak, and that if the head gasket were to fail out of the warranty period I would have to cop the bill for it! My girlfriend only drives 100miles a week or so, so more than likely if anything went wrong as a consequence of the over heating it would be months down the line.

Thanks for the replies.

Retailers all try to take the piss dont they. For example faulty electrical goods which are just outside their 12 month guarantee, the retailers say tough luck mate.... Until you mention the terms under the sale of goods act then they change their tune right away.

Carl - I know I know...Ive always bought private, but my girlfriend wanted to buy from a dealership as she wanted the security of having a warranty! Wish I'd bought private now. *oh well*

Rick - we got a Bravo T jet 150. I advised to buy a VAG but then it wasn't my decision in the end, and being an 08 with 18k on the clock it should still be reliable enough....so I thought!

Your rights are limited as a used car!
You can only reject for a major mechanical failure such as engine blowing up or a consistent problem or catalogue of problems!

hi matt, this is wierd, do you know if they have another dealership in leicester? i left a deposit on a car at the carshop, on the basis it was fit for purpose, had it inspected needed over £400 spending to make it road worthy, refused to give deposit back so now I have trading standards involved and my credit card company.

Wife's car came from them and it's been fine, did everything I told them to do before we would buy it.

Her dad had one from them - it was French, so the inevitable happened. They took it back, gave him another car for 2 weeks while it was sorted out.

This is the consumer wing of trading standards http://www.consumerdirect.gov.uk/ GO here for advice. I found them very useful when I had problems with a debt company asking me for money that I didn't owe.

the warrantees these car dealers hand out are usually by 3rd party companies and largely meaningless if you read them throughoughly, in future just buy private for a lot less and take your chances (its likely you are anyway)

They were trying to sell us extended warranty, stone chip protect, insurance for basically everything. When you worked it out it was well over a grand for it all!

If I had the time, I'd love to go over there for a day telling customers exactly what they are like. *angry*
