Got back to the car from shopping at lakeside,in their own carpark, which is free.

and there is a poxy clamp and massive sticker saying the car isnt taxed!
bollocks, as only this morning i had to get ripped off for £68.75 so i know for a fact i was legal,

called the number on the sticker and they said it wasnt taxed,we went on for a few minutes, and then she said even if it was taxed it would be a failure to display,
Surely not in a Private car park??!

they want £250 to take it off, in cash, and i have to prove when and where it was taxed?

what a load off tits!

No way i was leaving it there over night,
so got a lift back home and got some tools,
and took it off.
I called the company and asked them where they wanted the clamp delivered and after 5 mins off them being confused as to how it wasnt on the car they told me i would have to pay £1000 to them fortampering with DVLA property!!

is the clamp DVLA or the carpark?if the latter i would definately phone the dvla and see where you stand, i would also just cut it off, or if you can figure a way to remove it without damaging it even better.

its illegal to clamp anyone in scotalnd, a law you guys shoudl adopt, amount of scammers i hear is rediculous!

no limits on parking, as its only for the shopping centre, its massive,

but im 100% its for the tax, il be honest the disc wasnt in the window, as the holder i have is shit and fell off.

i dont really see what angle they have, it was on private property, so failure to display dont count,

i think in their eyes, no tax disc and still sorn'd on the DVLA datbase?

but come this time tommorow it'l be a different situation,

I will give the clamp back, its 100% not damaged as i managed to take the wheel off and lower ball joint, and brake caliper,
all in a record time i might add....lol

They stopped me from going to see 5 clients today, so i have lost ££......

the clamp is From NSL , who are as far as i can see a private firm working for the DVLA.


I wouldnt have minded, but the Tax was paid!!

My bro had the same sort of problem(van with no tax on a private ind est). If you go to your local council office and prove it is private property then send them a copy they won't have a leg to stand on.
This was how my bro got out of this.

Uhm DVLA don't have authority in a car park and neither do their agents? Because it's not the public highway. NSL's behavior sounds a little bit bogus to me.

Plus it's no longer an offense not to display, you have five days from the day you buy your tax to display it, eg if you do it online you can get it on the last day of the month and they give you the five possible days that it will take to arrive

Is there anything on the notice advising you about tampering with the clamp?

For legal and insurance purposes, Tesco car park is classed as a public highway so insurance etc applies, I imagine Lakeside will have the same policy etc, so unless you had the land owners permission to park there/mess around in the car park, you can still be prosecuted (i'm not saying you messed around, it's just an example)

I would have no remourse in hacking a clamp off.

Yeh, it seems since 2008 they have an authority to clamp cars parked anywhere but on a private dwelling. But it seems like they have to have prior knowledge of a car parked without a SORN declaration rather than cruise about on a fishing expedition. I'd ask how the car came to their attention.

I think the 5 day thing only applies to when the car had tax the previous month and to the period right after the expiration.

I understand the frustration though having paid tax and then to be wheel clamped by DVLA monkeys.

They can now clamp in any public place, which includes car parks the public have access too.



But as you clearly have not tampered with the clamp, you have done nothing wrong. You just removed your car from where the clamp sat.

I guess you could tell them the clamp is still sitting where the dumbass wankers left it, which is the same place your car had been parked. And you never done anything with it.

And whilst they may be allowed to clamp for no tax, that isnt the same as failure to display, and they certainly cannot clamp a taxed car regardless if it has a disc or not.

or you could send them a bill for the hassle and inconvenience caused, loss of work, stress, phone calls etc.

If other people can send out random bills, I see no reason why you cant especially as you have genuinely lost money due to their incompetence.

I fully agree with your tactics.

But NSL/NCP do work in conjuction with the DVLA for clamping.

At least that's who does all their clamping over here. The lazy bunch of cunts. Half the time the fat fucks are parked illegally stuffing their faces

I away thought that it was towed away if not taxed not clamped. Try google it we had simler thing at meadow hall stayed over the two hours limit. They take photos of you comming in and going out with the time. When we look on google we found it to be a scam.

funny there should be a topic about this, i was nearly caught out this morning!

my mini is parked opposite my house in a little carpark/ garage lot. my tax ran out the end of last month and i declared it sorn as it's off the road for the turbo conversion. So this morning at about 8am i look out the window and theres a DVLA van next to my car with a load of cameras on top, by the time i go outside the vans gone, no clamp nothing.

Then i'm on the phone all morning to the DVLA being passed from department to department to see whats going on and if i've been given a fine or not. So they say you'll only get in trouble if it's on a public road.

So then i'm same again on the phone to council and luckily it was privately owned land.

James - 1 DVLA - 0.
