where do i stand???

recently ive sold some parts on here from my turbo build, and sent my other half down to the post office to send 2 of my parcels, and to get prices for postage for the other 2, as 2 buyers had already sent me the funds.
she then sent 1 that she was not supposed to, so i inform potential buyer of the mistake and hope that they were a honest and enough person and that they would send the item back upon receiving it.

no such luck!!
they have informed me that they have not received the item yet.

now could be an honest mistake and he has not received it, which was sent before crimbo, or a nice expensive part comes through the post which you havent paid for!

so where do i stand in this, i have receipt of postage with address marked on it.
not sure what i can do??

If you have all the correspondence between you and the buyer then I suppose you could contact the Police but then you would need to prove he received the item. You could of course pay him a visit but as far as recouping your losses is concerned I don't think you have a leg to stand on.

It may very well be that the parcel was lost and you can claim through Royal up to a maximum of £39 if sent by standard post.

There are some very dishonest people unfortunatly and it does seem abit suspect that they 'didn't receive' the item when it was sent as a mistake before they paid for it.

It's theft, if they deliberately kept it without paying.

you could take it to the police if you can prove:

they received it,
they didn't pay, and they should have.

You sent me the duplex vernier before I paid for it too, I did however pay for. I hope whoever it is reads this and pays up. If I got my part then so did you...

As a TM mod, if you like, you could PM me the name of this person so I can tell you if they are a regular upstanding member - just so you get an idea of what youre dealing with.
Ill keep it completely confidential, though may discuss it privately with Admin.

Apparently I've been offered a part [in reply to my wanted add] from someone who 'didn't receive' an item from fordimus maximus

I have a very good idea whom it is in that case. In fact I pm'ed Tom about them just the other day as they seem to be abit dodge if it is who I think.

if its signed for then you have proof that its been stolen. you have their address too, so tell the police and proove they signed for it then they can go and sort it out (hopefully)

its was not recorded delivery so i only have the standard receipt, as she was Not supposed to send it.
i may look into the police but again i cannot prove he received it.
a visit is maybe on the cards, i have several cousins in the traveler community who live near by and may pop round to see if they have had any deliveries recently.:)

Joe no one has accused anyone of stealing its only an assumption.

Its an assumption because its very very unlikely that "it got lost in the post" we all know that post gets delivered but how badly its damaged when its delivered is a different matter.

I think the lesson here is use recorded for people you dont know and especially if the member posts up twatish posts as this is quite a good indication of the type of person they are.

Shame its happened here other sites i can understand because of the type of posts posted, here though people are considered decent and i hope this is not a sign of things to come.

just to play devils advocate, i thought that if you recieve something in the post (or by any other means) that you did not specifically request, the onus of recovery (and cost of recovery) is entirely upon the sender.

but in cases like this where an honest mistake has been made and someone is trying to take advantage of it (i dont know if this is the case or not, im not getting involved) id say its just bad luck and the recipient's a bac

I'm not sure if the same rules apply to a non buisness situation but if you receive goods that you are not entitled to and don't take steps to return it or don't cooperate with the sender to return it then you are liable to be charged for the item in question.

However I don't expect that applies here considering the actual circumstances.

hi maximus is talking about me guys. ive already told him no items have turned up,as i havnt signed for them and i was enquiring about them but at the same time i was offered a complete metro turbo engine which you can see in my pics.in the introduce yourself.at end of day im not going to rip somone off for £120.when i just paid £700 on a complete engine with spares.also as i already told maximus at the same time this item was sent i was paternity leave for 4 weeks as my daugher was born early via emergany c-section . And its my dad that owns the company where it was sent and dont think he would lie, so its either lost in the post or sent to the wrong address . And i dont appreciate the threats and accusations when i have not done anything wrong.
If maximus has any issues he should pm me direct not start a thread where i cant defend myself

We all knew he was talking about you. Of course you wouldn't have signed for it, it wasn't sent recorded, you know this. In all fairness I don't think being able to spend £700 on an engine makes you immune from stealing. Not that I'm saying you did but you had to pay for your engine before you could take it where as in this case it could have been taken and nothing proved. No offence but none of your reasonings stand.

ETA I don't see any threats there. In fact the only threatening behaviour I've seen is when you threatened Wolfie
