My clubman estate has been murdered by a ford puma!
I was leaving my lockup on sunday late afternoon, just turning left out of the drive and out of nowhere from the left a car hits the front end of my car! It turns out the the girl driving was overtaking another car and started overtaking just as i began to pull out..
The whole front end of my car is in need of replacing...at a cost of £2400!
Whats my chances of getting her insurance company to pay that out?
Will put some pics up once i work out how to get them from my phone!

if youve got lots of pictures off the scence and a very strong argument that it was compleatly her fault then you might have a chance,

aslo what the value of the clubby?

13.95 1/4 mile on a 2.95 fd. Carnt be that hard to beat!

I'd say the value is probably about 2500 ish? well thats the average price of estates for sale at the moment, that would be of similar condition to replace mine.
She admitted that she was driving stupidly at the time and she did want to sort it out without involving insurance, until i told her how much it would be to repair it.

Tricky on that. You shouldn't overtake near a junction, but if it's not a solid centre line it's not an offence. However, if she was going very fast, she may be to blame.

Unlucky though.

Fastest 998 mini in the world? 13.05 1/4 mile 106mph

Somewhere around Swindon

I would suggest you state a few highway code rules
Rule 146: Where there are junctions, be prepared for road users emerging

Rule 154: Take extra care on country roads and reduce your speed at approaches to bends, which can be sharper than they appear, and at junctions and turnings, which may be partially hidden. Be prepared for pedestrians, horse riders, cyclists, slow-moving farm vehicles or mud on the road surface. Make sure you can stop within the distance you can see to be clear. You should also reduce your speed where country roads enter villages.

Rule 167: DO NOT overtake where you might come into conflict with other road users.
For example
Approaching or at a road junction on either side of the road

I would also say that she was the one on the wrong side of the road not you all worth a try i think

well the insurance companies have been informed, will have to wait and see what they decide i guess..but i do have a witness, the person she was overtaking..if he was to say he was doing 40mph, which is the limit, then surely she should not have been overtaking.

Near Paris - France

Dunno about England but in France, even if it is not your fault, your car is being fixed up to it's value, then it is your call to add from your own pocket if you want it fixed.

The difficult point being the value ...

|ZAdam, i'm not trying to kick you when your down, but when you join a road from a siding you must give way to traffic already on that road,
the only chance you have is if she was overtaking on a solid white line, or solid chevrons ,

show us the road on google earth,

Get a note for the doctor saying you have whip lash. Some compo will fund the bill. Everyone else does it. Where's there's blame there's a claim.

£2400 damage on a vehicle valued at £2500 will not be repaired, since an estimate for repair is just an educated guess at the cost. There will always be complications and there just is not enough value left in the car to make it worth anyones bother to repair it, plus, if they find any rot, they will not cover the cost of repairing that.

If they give you the £2500 'value' take it, unless you have an agreed value insurance policy

Also get a second opinion on repair costs. Insurance approved repair is a con, I got rear ended in my company van and when I picked it up I asked for a list of parts that had been fitted - over half of the list had been made up and wasn't even needed.

Speak to the insurance and say you'd like a classic car repair shop to handle it. They'll let you do it but might take a little longer as they'll send an inspector to verify the quote. Good luck!!

there is no solid white line on the road, so she was fine to overtake..but she must have seen my headlights lighting up the road, as i was just about to pull onto the road it seems she decided to go ahead with her overtaking manoeuvre, because she was in a hurry to get home, there are lots of driveways along the stretch of road, just seems a bit thoughtless to me.
