Annoyingly this week someone decided to see how far they could shunt my car, by driving into the back of me at 30mph when I was at a stand still! *angry*

Ive taken my car into for assement and as I suspected, they said it couldn't be repaired. My main concern now is that I may not get enough money back to cover the cost of a replacement car. I bought the car 3 months ago for £1100 as it needed some work doing to it, but when I have looked about I can't seem to find anything of the same standard/spec for less than 2k.

Are the insurance companies obliged to pay you enough to buy a car of the same spec, or just what the "list price" is of your car is?

I should be getting a courtesy car in the next few days, but from what I understand I have to give it back within 7 days of a settlement...this seems a bit wrong as it kind of puts you under pressure to buy the first thing you see. Do you think I have a case to keep the courtesy car untill I find something suitable? 7 days isn't long to find the right car for the right price and in the right location!!

I've always gone to the assessor armed with printouts from autotrader etc showing what a replacement car will cost. Never failed me, even worked for my mum.

After all, you aren't buying your car you are buying something comparable to replace it with.

Yep the bloke at work had three cas totalled in 2 years, none his fault. He negotiated with autotrader ads. He always got back more money than first offered.

I run a supercharger and I don't care the TB is on the wrong side.
VEMS + 12 PSI + Liquid Intercooler = Small Bore FUN!

Stand your ground. My brother had an issue a couple of years ago when his car was stolen. He used local autotrader adds to support his claim. The insurance company tried this too however he politely suggested if they could find the same spec car but at the other end of the country for cheaper that they bought it for him and had it delivered to his door. He eventually got a reasonable payout.

They should pay out market value so what you paid for it shouldn't be an issue, particulary as it is not your policy paying out.

As for the courtesy car, i'd negotiate this as well. My dad had his car written off a few years back and he managed 3 weeks out of them as he advised he was too busy at work to take time off to look for a new car.

Ah thats good to hear. Ive had images of them giving me £1100 or more than likely less, then having a week to find something for that money. *oh well*

Im unable to drive and been signed off work at the moment, as ive pulled ligaments in my neck, pulled muscles in my back and shoulders, both my shoulders now click when I move them and so does my back. The insurance company were trying to get me to drive a 60 mile round trip to collect a courtesy car...obviously I told them where to go!

I got more than we paid for the leon by negotiating hard and giving good evidence of value, that said i got more than a fair amount when i whacked my audi as a first offer.

Matty , do not panic and do not let it ruin your day,
you are in a stroing position regarding the third party insurance,

they may try to deal with you direct, this is in thoery the best way forward as it keep idmain costs down and you should get it sorted sharpish,
but do not let them walk over you as pointed out above,

they too willb e lolkknig at the auto trader for similar cars, but will always come ni with a piss poor offer, it's all part of the game,

when my oldest daughter put her car on its roof last year her insurance made a piss take first offer, i compiled on of my legendary condecending replies and theyb soon got the idea, ende dup being payed out more then she payed for it,

if they do start to get shirty, kindly ask them to send you no money at all but simply let them find a suitable replacement to your approval, they will soon come around,

tell them you'll collect from 30 miles away but want £30 per hour to do so

If you've been hurt that badly as well buddy be sure to claim for compo, you can also claim for the rise in your insurance premiums for the next 5 years because most companies ask for accidents REGARDLESS of fault nowadays.


I get the impression if its going to cost you money to get back to the same position as before the accident you can claim for it :)

Concerning your pulled ligaments and muscles, make sure a medical report is properly documented aswell.
Whiplash is something to take serious.
A friend got hit from behind (at high speed) and was still not able to work 100% after a year; insurance had to cover that aswell.

Thanks for all your replies. Im in the middle of sorting a compo claim out, most of the aching has gone, im now just left with my clicking shoulders and back! *oh well*

Cars definitely a write off and they've offered me a fair amount for it, the only problem now is that they are telling me that as it has been written off, as of today I am only allowed to keep my courtesy car for 7 days from today. *angry*

Bearing in mind im not sure how my back will be driving long distances I think giving only 7 days is a bit of a piss take. My cheque wouldn't of cleared by the weekend which means I'd have to take time off work during the week if I want to use the courtesy car to find a new car to buy...I told them if they gave me more money for a replacement car it would make it easier to find a suitable replacement woud they didn't have any of that.

Am I wrong in thinking that 2/3 weeks not an unreasonable amount of time to look for a new car?

I would tell them that you are keeping it until you find a suitable car. Why should you be inconvenienced further because of their clients inability to stop their car?

Exactly.

Its a piss take that you get 3 points and a fine for slightly exeeding the speed limit or other trivial things, yet nothing happens to these asshole drivers that cause real harm to people/property through negligence or recklessness.

Stick to your guns and don't accept any offer until your happy. I'm pretty sure they can't write off a car until a settlement is agreed as you are within your right to drop the claim (not that you would).

Where i'm getting at is the the car is yours for now and use this as a hold until you get a bit more for the courtesy car
