I was having a read of this last night, some interesting reading, however something I noticed, you can be given 3 points for failing to report an accident to the police, now this is a grey area, what should you do if you have say a minor bump for instance at a junction? No-one injured, all insurance and address etc details swapped and both parties happy considering the circumstances? As personally if in this situation it would not occur to me to report it to the police, but should you do so??

if you want to save ure licence then dont speed, or act like a penis on the road..... section 170 of the road traffic act states that at an rtc if another vehicle is involved, you must exchange details (if damage is caused to it) if you both had a bump and say it was down to you, but no damage was caused to his vehicle, but there was damage to yours. you dont have to give him your details, but he has to give you his........although you would be a penis not to just swap details.........
what is an accident ??????

section 170 states that
owing to the prescence of a mechanically proppelled vehicle, on a road or public place, an accident occurs whereby a person is injured, other than the driver of that mechanically propelled vehicle, or damage is caused to a vehicle other than that mechanically propelled vehicle, or trailer drawn by it, or an animal other than in that mechanically proppelled vehicle or trailer drawn by it, or damage is caused to anything growing, fixed to or otherwise forming part of the land, or land adjacent to such land.

this is a reportable accident, and if your situation applies then you should report it to the police within a reasonable time (normally 24 hrs) or if it is a simple bump exchange details with the other party

case scenario. after a long day at avon park, you are driving back home, your trailer un couples and goes into a farmers fence / bush damaging it. no one has seen you, but there is damage to the fence. it is your duty to inform the farmer/land owner. this cannot be done therefore you contact police and they take your details and inform the land owner on your behalf. failure to take these steps may make you liable to summons to court for fail to report


tom your case does not apply as no injury, and details have been exchanged, as long as in your case that no neglegence was involved. problem being that 9 times out of 10 the person who has been bumped cries whiplash......bingo there is your injury rtc and police must be informed.

I have to admit that this is what I thought when I first read this. I do speed sometimes, not all the time. When I inevitably get caught, I'll have to take the wrap for it. I know that I speed, and if I didn't want to get in trouble at all, I just wouldn't do it.

I'm so boring! lol

Yes my attitude as well, 2 years ago I got caught doing 48mph coming into a 40mph limit from a 60mph limit, I was pissed off but as my Dad said "You have been driving about for 6 years and it is not as though you creep about either. So take it on the chin and think yourself lucky it was only that rather than getting caught doing triple figures on the motorway."

He was right.
