Somewhere around Swindon

Does anyone work in the insurance industry? have a friend or family member thats a claims assessor ????

i feel like i am at a cross roads with regards to my multiple injuries claim from my bike accident and really could do with some advice from someone who knows what there talking about

i also feel my solicitor is not defending my corner that well and i get no real advice from him at all

i feel pushed into making a desision that may have a major impact on my claim

I cant really advise on the situation, but if your solicitor is not helping it maybe best to find another. I've had to do this before when my mrs had some problems, the welfare rights people were just too busy in this case and i changed to another who specialised in that area.

Wolfie, not sure about insurance, but traffic law i can help you with, if you put down ure points of what has happened at the scene, and i will see if i can help.

also if ure solicitor is working for ure insurance, give up now !!!! they dont give a F**K i had forensic photogrpahs, full vehicel examinition (by someone who was qualified under sec 67 ) and the wank splashes still paid out !!!!!!

let me know, i am on night shift at the mo, if it can wait till the morn (when i reply to ure post)

The blame part of the accident is not in doubt, he jumped a crossing at neirly twice the speed limit slamming inti the side of me

he admitted being responsible to the police that attended then did a runner overseas

my problem is the insurance has offered me a good amount of money but its approx a third of what was the lower limit of my claim, my solicitor has written 6 pages to me with shit loads of confusing options but not a scrap of help, to comlicate things i have been told i have an underlying illness but to what degree i wont know untill test results come back next week, the insurance company are also pressurising me into making a decision

there are other issues that make it even more complicated and i really dont want to go into on a public forum

if you are stuck.

if iam reading between the lines correctly, the man has admitted fault, and i presume as been prosecuted for (dangerous / careless) if so you need to liase with the police to find out what has happened with the case....if he has nicked off prior to case disposal, then you would have to wait until he returned, or ask the police to badger his family. if there is a case you need to speek to the oic (officer in charge) and complete a CICA form (criminal injuries compensation application) and fill out your details, this will pay out alongside your insurance, helath insurance, and pending on ure policy life insurance. if you are stuck for cash (and i am not telling folk to go out and lie) then claim disablitiy alowance from the government, disablitly dont mean you got to be confined to a wheel chair, but if your quality of life is affected then you could fall within the remit

if police have an address ie from a relative of the offender they can serve him a letter summonsing him back to england to attend court, if he refuses, it could make matters worse for him as if police over there are made aware he may be deported as a wanted criminal (even though in the scheme of things its a minor offence)

if his insurance admit liability and you can provide tangiable proof of injuries ie medical reports, then under third party agreement law they have to pay out to cover your costs, its the whole point of insurance ! they will drag their feet, as they dont like paying out, however if you threaten them with the standards agency it normally motivates them....that and the press always works a beaut

Ring your Solicitor go see him and get him to go through that 6 page report and any other options in laymans terms.Remember they are working for you.Probably the insurance are trying to settle early to limit their future liability.If you don`t need the cash Id ride it out and go for the max amount,but this must be decided with the help of your solicitor,so get talking.
