Hey, I need some advice


I crashed the mini at the beginning of December, and received a letter today to say that "I may have committed an offence contrary to section 3 by driving without due care and attention and, or without reasonable consideration for other road users"

The accident was my fault, I pulled into someone where 2 motorways meet, windows were a little misty, water on the wing mirror, didn’t see them but was my fault. The person I hit had a small dent in the driver’s side, no other injuries or people involved, she stopped gave me her and telephone number and left because she had to go to uni. I waited for the police they talked to me and another witness.

No previous points for speeding/anything

Does it normally take this long to come through, and do they just send it out as scaremongering or do you think they will try to prosecute.

Strange the police even attended, they usually couldnt give a toss unless someone has been injured.

Been there, done that, albeit mine was in 1986 on a motorbike and I got a CD10 on my licence for 3 years, 3 points and an £80 fine. But mine was dealt with within a month of the accident occuring.

I'd go see the Citizens Advice Bureaux if I were you.

Or go to a solicitor, the first 20-30 min session is usually free.

I'm stumped it's taken so long - you could have grounds that the courts would dismiss this just on the delay alone.

IMO, you need to be careful about talking about misty windows and mirrors as it's the drivers responsibility to ensure clear vision before moving away. If they steam up while driving then that could be different, but might be grey enough to go against you if this is gonna be taken forward.

Just my opinion though, as I said, suggest you go seek proper advice.
