3 1/2 weeks ago my trailer was hit

I was towing the unladen trailer along a road in swindon, this road has a wanker lane(where people who cant be bothered to que push in) but this wanker lane joins from the right into the left with clear arrows, a saab 93 started jumping the que so i closed up the gap infront while in a que off traffic doig 15-20 ish, he came along side my rear 1/4 reolised there was no room infront braked pulled in behind me and smashed into the trailer, i got out and told him to pull in next layby he did not and i had to chase him down the road and make him pull in, he addmitted it was his fault said he did not see the trailer ect

i phoned my insurance but they said that although i am fully comp what i am towing is covered 3rd party only so i need to contact his insurers, i have contacted his insurers (direct line) but have had a run around, i have insisted they send a claim form but they have not and now ive found out he is contesting claim saying i undertook him and moved into his path ... to do this would mean i would have to put the 406 in the oncoming traffic

where do i go from here?

stick a sign, bill board at the scene explaining, you never know someone may come forward and nail the twat.

If nothing else report the twat to the law for leaving the scene of an accident.

i'd say so. he didnt stop at the scene, the fact you had to chase him probably makes it worse for him as you actutally have his details!

No harm in asking the cop shop. they can always say no.

Well worth going for witnesses as well if you can.

As far as I see it he moved into your lane. Regardless of the fact that you may have closed a gap, it is his fault. Your legal cover on your insurence should still deal with a claim for you.

Tell the insurance company too that you had to chase him too. Major nicking leaving the scene of an accident. You were in front, he hit you up the ass....9 times out 10 you'll come out with a result chap. :)

It sounds like its worth getting pics of the road layout, from what you say these should show that it would be impractical for you to have hit him.

I agree, him leaving the scene is worse than the actual fact he drove into you, as far as the law is concerned!

By the sound of things his STORY seems soo far fetched that no one would believe that anyway.

accidents insurance is allways a nightmare, if your fully comp then trailer must be fully insured,only the cargo you carry is not insured, ie goods in transit, have been down this path, my dad collected my van on trailer he had front wheel blow out rolled complete lot, payed out on his car and my trailer, was told by insurance company to sue my dad, both of us were insured by same company, olso if my dad had being towing the hot rod we would have got payed for that, NIGHTMARE

spoke to direct line again today and escalated the problem, lady asked if i could take a photo of the accident scene and email to her, she is also writing to the prick and given him 14 days to resond if not it will automatically go in my favour

Did it do much damage to the trailer mate?

broke brake rod, o/s rear stub axle, mudgard and rear light

from my experience insurance is a lottery.

the reason we exchange insurance details is so they can talk to each other, then they look at there customers cover, the damage and cost to repair, then they do over the person with least cover and the most costs so costing them less!

hope hes gone on his hols for 3 weeks and doesnt get the letter mate - automatically in your favour - go to the cops though - had to do this when my dad got hit the guy didnt have any insurance and buggered off

Just keep on top of it! Keep in regular contact with his insurance letting them know that you are not willing to accept anything other than totally liability from there insured. Collate as much info as poss about the scene, photo's drawings and when writing report about incident don't deviate at all from blaming their insured!!!

i think ive just fucked it up

i rang him to ask why the fuck he was lying to the insurance company, i lost the plot when he said on the phone it was his fault but he was not going to tell the insurance company this, i fucking lost the plot told him i was going to really fuck him up and ill see him shortly

i doubt my threatening him will go down well
