Not having a good year so far, had flu from xmas day, almost severed my thumb on the 3rd of jan chopping kindling for the fire, and now been in a bad smash...

A young girl went into the back of me on saturday @ about 60 whilst i was stationary waiting for the bloke in front to turn right

Her car (focus) was completely creamed, she was fine, i was in my old mans volvo v70 awd turbo which is nicely folded up too couldnt open my door as the body was twisted, so had to escape via passenger side

The copper has just been round to take my statement, and said that she has been noticed before and been pulled a couple of times for dodgy driving, and also might have some undeclared mods to her car (induction, exhaust, suspension etc) and this might cause a few issues with her cover...

where does that leave me? if her insurance co. tells her to sod off, will they still pay me out?

Also, i was rushed straight to A&E, as was in a bit of pain from the seatbelt, had the usual checks/xrays (had a bit of a drama with a young foreign doctor who tried to take some blood, but thats another story), was in there all day till nitetime, luckily nothing broke, but that night and since then i have been unable to sleep due to the discomfort in my neck, got given some voltorol at A&E, but it just makes me wobbly, ties my stomach in knots and makes little difference to the pain, everytime I yawn or laugh its agony though!

So just been to the docs and got some magic tramadols which is good stuff (just about kicking in now)

Whats the procedure for putting a claim in for some compo? do i need to go to a lawyer etc??


On the upside, i look like avid merrion with my dodgy neck brace, and havent been in work at all so far this year, but Im bored shitless, daytime tv is utter bollocks, and nextdoors house is being gutted so cant sleep as noisy as fuck, might try and work on my COD4 rank...

Where theres a blame there a claim, get your ins company onto it. They will ensure you get the money for the crash (she will end up paying more though iirc) but as you have hurt yourself you should claim compo for that too, as thats the only way you will get the true value of your car back! also a nice hire car for the time you are without one!

was she fit?

Sorry to hear all that Joe. A sombre thought but thank god you were in a Volvo rather than a Mini.

If her insurance company tell her to sod off it will be to stop themselves having to pay you, so you could be in the deep stuff. However, if it comes to it, you can sue her for personal injury and damages.

However at present my advice to you would be to keep a diary each and every day. If you cannot sleep through pain write it down. If you feel sick, or cannot do something that you normally would, write it down. Any contact with the police, doctors, insurance co's, log down who you spoke with, date and time, and regarding what.
All this could prove to be either something interesting to look at a few years down the line, or something that might be needed in a court of law.

I would also go and see a lawyer and outline what has happened, they will obviously be able to advise you on what you ought to do.

If you have legal expense cover on your insurance you should be able to make a claim through that for both the outlay/excess/damage to vehicle and any personal injury.

If not you can go through any solicitor offering a no win no fee agreement but I would say it would be better to go straight to the solicitor rather than through a claims management company.

If she has issues with her cover they may still be liable for your damages as RTA insurers but she may not be able to claim from her own insurance.

Dread to think, if it was in a mini i think i would be in a very bad way right now, scary stuff!

Ill ring Tower (my insurance co) and see what they say, im on my old mans motor traders policy, so not sure what the specifics of the cover are (legal cover etc) although I imagine its quite comprehensive, if theyre no help ill have to seek legal advice

Definitely a good idea, the fact that it will already be evidenced on your hospital and GP records will definitely work in your favour.

Really sorry to hear that. I hope you sort it out soon and the neck problems clear up soon.

I won't go off on a rant about insurance companies but it does make me think about putting the rest of the roll cage in my mini.

if the neck gives any greif go to a doctor, i'd be suprised if you don't have whiplash to some degree considering.

At least it can only go up hill from here. If the insurence company tell her to sod off it shoud only be for any comprehensive cover she has. The third party should still be valid. At least that is how I think it works. It is impossible to second guess insurance companies.

I hate to advise to use these sorts of companies, as it runs up costs which impacts everyones premium.
But when I was knocked off by bike (hit and run) by an uninsured driver they have sorted it all out. I used Direct Acccident Management.

Good news, spoke to my insurance co, were tops about it, they have a whole system in place for this sort of thing, once we send in all the details with the police report they will send out all the necessary claim forms, will keep a diary as you guys say so its all noted.

ive got to say this tramadol is brilliant stuff, has numbed it all down to just a mild ache now which is a massive relief

lizard, ill be back online in about half an hour or so, just waiting for a chinese to arrive, my username is 'captain holtby' :) got a 14 kill streak just before, happy days!

the mods wont affect your claim mate,it will only affect her claim for her car, the 3rd party bit stays regardless of undeclaired mods drink driving drug driving driving with out due care ect ect

yeah A&E gave me some stuff called dicloflex (its an anti-inflamitory with voltorol mixed in), but it didnt agree with me, so when i went back to the gp on monday he gave me some other stuff, arcoxia, which doesnt make me feel sick, but doesnt seem to be doing an awful lot :(
